The former personal bodyguard of Ex-President Jerry John Rawlings has failed an appeal at the Supreme Court seeking a reversal of a ruling of the Court of Appeal that set aside a judgment of an Accra High Court, which declared him as rightful owner of a piece of land situated at Oyarifa, a suburb of Accra.

In his appeal before the Supreme Court, Mr. Patrick Kuntoh, is requesting the court to restore the earlier decision of the trial High Court, declaring him the owner of the land in dispute.

According to Mr. Kuntoh, the Court of Appeal presided over by Justice Isaac Douse, with Justices Acquah and Ayebi as additional panel members erred in law by declaring that the trial High Court did not have the jurisdiction to handle the case.

The applicant further noted that the Court of Appeal had caused a blunder for holding that the respondent, one Angelo R. Adukure was not given adequate notice of hearing, notwithstanding the overwhelming evidence of service of available records on him.

It will be recalled that an Accra High Court in a suit filed by Mr. Kuntoh seeking a declaration of title to a piece of land situated at Oyarifa, on March 13, 2009, ruled that the former President’s Personal Bodyguard was the rightful owner of the land and that all the other defendants were encroachers.

In the said land suit, Mr. Kuntoh had sued six individuals including Mr. Adukure and the Lands Commission for an order for the recovery of portions of land entered upon, purportedly alienated or developed by the six defendants, and had further sought an order for perpetual injunction to restrain the defendants, their servants and privies.

However, the Court of Appeal on May 3, this year, ruled and set aside declaring Mr. Kuntoh as the rightful owner of the disputed land.

It was the view of the Court of Appeal that Mr. Adukure was not adequately served with notice to appear before the court and as such hand been denied of natural justice.

Author: ARYEE;;; I still do not believe this has happened: That a group of Ewes or Anlos went to the Moslem cemetary to exhume the buried/dead body of an Imam and dumped it elsewhere, because of some misunderstanding between Ewe/Anlo Youth and Zongo community. It is scary to imagine a group of people ordered by their elders to remove a corpse buried in such Islamic tradition of only shroud/no coffin from a cemetary ground. How did this come to their mind? who are these people in Ghana doing this? Its so Unghanaian and against tradition, science, sensibility and certainly defy every wiesdom on earth. Even sworn enemies of Shias and Sunnis wont ever do this to themselves. To be able to remove dead bodies not in coffins is itself a grave health risk, and the social implications are frightening and mind boggling. These people are strange and horrible, and to think of it that their leaders have been ruling us for so long explains why Ghanaians were driven from their homes into exiles in such numbers to waste awaY. I FEAR EWES AND ANLOS. THEY ARE SO EVIL AND FOUL MINDED. Their elders and chiefs must apologise unresevedly to Zongos and all Ghanaians. it has never happened in my own lifetime Could somebody give me one example of such incident anywhere in the world. Undeniably, the moslems attach great importance to the dead in such a manner that even Osama Bin Laden was given a decent burial. Moslems bury people in shroud and no one disturbs their dead..I am so worried by theis action and caution Ghanaians to be very careful of ewes and anlos. they are just mad evil people. Right from my infancy, I heard ewes or anlos are very wicked people but despite all the murders committed by Kojo Tsikata and Rawlings and their people in Ghana, I thought it was because of their so-called revolution. But now, my mind is made up; that ghanaians must be wary of any ewe or anlo person. Shame unto ewes and anlos of Volta Region and every where else. Whenever I see them I will remind them of this particular abomination and sacrilege committed against the tenets of Allh. may they face evry curse on earth so that they will know that the world does not belong to them. To remove dead body of a moslem from a cemetary and throw it away in anger. You must be sick in your head to do so and all ewes and anlos must bow their heads in shame.
